These Terms & Conditions ("Terms") govern your access to and use of the website at trueroof.com.au and the services provided by True Roof Pty Ltd ABN 25 322 770 659 ("True Roof", "we", "us", "our"). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Services
True Roof provides residential and commercial roofing services including but not limited to roof restoration, roof cleaning, repointing, leak repair, gutter mesh installation, and related works. All services are subject to a separate written or verbal agreement, quote, or invoice, the terms of which are incorporated into and governed by these Terms.
Quotes are estimates only and are valid for 30 days from the date of issue unless otherwise stated. Final pricing may vary where site conditions differ materially from those assessed at the time of quoting. We reserve the right to decline any work at our sole discretion.
2. Online Shop Orders
Orders placed through our online shop are subject to availability and acceptance by True Roof. We reserve the right to cancel or refuse any order. Where an order is cancelled by us, you will receive a full refund of any amount paid. Please refer to our Returns & Refunds Policy and Shipping Policy for further details.
3. Payment
Payment terms are as stated in the applicable invoice or checkout process. For service work, a deposit may be required prior to commencement. Overdue accounts may attract interest and recovery costs. We reserve the right to suspend or withhold services where payment is not received in accordance with agreed terms.
4. Warranties
Where we issue a warranty for services or products, the warranty terms will be set out in the relevant warranty document provided to you. All warranties are subject to the conditions specified therein. Nothing in these Terms is intended to exclude any guarantee or consumer right that cannot be excluded under the Australian Consumer Law ("ACL").
To the maximum extent permitted by law, any implied warranties not otherwise protected by the ACL are expressly excluded.
5. Limitation of Liability
To the maximum extent permitted by applicable law, True Roof's total liability to you arising from or in connection with these Terms or our services (whether in contract, tort, statute, or otherwise) is limited to the amount paid by you for the specific service or product giving rise to the claim.
In no event will True Roof be liable for any:
- indirect, incidental, special, or consequential loss or damage;
- loss of profits, revenue, data, goodwill, or anticipated savings;
- loss or damage arising from circumstances beyond our reasonable control, including weather events, pre-existing structural defects, or materials supplied by third parties.
This limitation does not apply to liability that cannot be limited or excluded under the ACL or any other applicable law.
6. Indemnification
You agree to indemnify, defend, and hold harmless True Roof, its directors, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use of our website or services;
- any breach by you of these Terms;
- any inaccurate, incomplete, or misleading information you provide to us;
- any access to your property granted to us that is not authorised by the lawful owner or occupier;
- any pre-existing conditions, defects, or hazards at the property of which you were aware but did not disclose to us prior to commencement of works.
7. Property Access & Site Conditions
You warrant that you are authorised to grant access to the property at which services are to be performed and that you have disclosed all known defects, hazards, or conditions that may affect the works. True Roof accepts no liability for loss or damage arising from undisclosed site conditions or from access that was not properly authorised.
We take reasonable precautions during works; however, minor incidental damage that is unavoidable in the performance of roofing works (e.g. marks from cleaning equipment, minor movement of roof material) does not constitute a defect or a breach of these Terms.
8. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of any third party. You must not:
- attempt to gain unauthorised access to any part of our website or systems;
- use automated tools to scrape, copy, or harvest content from the website;
- transmit any harmful, offensive, or unlawful content.
We reserve the right to suspend or terminate access for any user who violates these Terms or who we reasonably believe poses a risk to our systems or other users.
9. Intellectual Property
